Birds and pollinators need native plants to survive. Why?

96% of North American land-based birds feed insects to their chicks so they can grow strong enough to leave the nest! Even hummingbirds feed insects to their chicks! Almost all of the insects eat only the plants they evolved with – native plants! So if there are no native plants for the bugs, there are no bugs for the baby birds. And no more baby birds means no more birds!

We’ve lost more than 3 billion birds in the last 50 years

mostly due to habitat loss. But you have the power to change that! How?

By changing your landscaping from mostly turfgrass and exotic (non-native) plants to natives that provide food and shelter year-round for resident and migrating birds.  Native plants provide seeds, berries, nuts, nectar and yes, insects for growing chicks!

Native Plants are better for water, wildlife and you! Why?

Eligibility

Awards will only be given for gardens on residential property located in Volusia County, Florida. You must be 18 years or older to participate. At least nine $500.00 awards for native plant gardens will be given out.

Board members and committee chairs of Halifax River Audubon, Southeast Volusia Audubon and West Volusia Audubon, and their immediate family members, are ineligible for participation.

All winners Will be notified MAY 10, 2023.

Use of Award Money

Award money can only be used for the purchase of Florida Native Plants. Plants must be purchased within three months of receiving the award.

Use of Garden Images and Progress Reports

By entering Audubon’s Plants for Birds, Butterflies & You Contest, you agree to provide Audubon with digital photos and updates about your Florida Native Plant garden every three months for two years after winning. You agree to allow Audubon’s representatives to visit your garden and take photos. You grant Audubon permission to use your photos and progress updates on our website(s), in social media posts, in newsletters, in press releases, in presentations and in any other medium where we promote native plants gardens. Your name and address won’t be utilized unless you ask us to.


Audubon’s Plant Real Florida for Birds, Butterflies & You Contest Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. NO PURCHASE OR DONATION WILL INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY.  VOID WHERE PROHIBITED.

1.  Eligibility

Audubon’s Plants for Birds, Butterflies and You Contest (“the Contest”) is open to legal-resident property owners of residential properties in Volusia County, Florida, who are at least 18 years of age. Awards will be given solely for garden installations on residential properties located in Volusia County, Florida. 

Board members and committee chairs of Volusia County Audubon Chapters– Halifax River Audubon, Southeast Volusia Audubon and West Volusia Audubon, and their immediate family members, are ineligible for participation in the contest.

2.Sponsor

The Contest is sponsored by Halifax River Audubon and West Volusia Audubon.

3.Agreement to Official Rules

Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon complying with these Official Rules  and fulfilling all other requirements set forth herein.

4.Contest Period

The Contest begins on February 1st, 2023 at 1:00 A.M. Eastern Standard Time and ends on March 31, 2023 at 12:00 A.M. Eastern Daylight Saving Time (“the Contest Period”). Entries that are submitted before or after the Contest Period will be disqualified. Submissions will be accepted for the duration of the Contest Period using any of the following methods:

5.How to Enter

Online:  this method of entry will be available by visiting our website (https://www.westvolusiaaudubon.org/P4Bcontest) and following the directions provided to fill out the entry information (Entry Form) and submit.

Via Mail:  this method of entry will be available for the entire contest period. Go to our website (https://www.westvolusiaaudubon.org/P4Bcontest) to download the entry form and/or to copy the content of the format to submit entry.   Entries should be submitted on pages no larger than 8.5” x 11” and must have contestant’s full name, complete address, phone number (including area code), date of birth and email address (optional) and be mailed in an envelope with proper postage affixed to: CONTEST c/o West Volusia Audubon, P.O. Box 1268, DeLand, FL 32721-1268 or by emailing your entry to westvolusiaaudubon@gmail.com and putting “CONTEST” in the subject line.  Mail-in entries must be post-marked no later than 12:00 A.M. Eastern Daylight Saving Time on March 31st, 2023. Emailed entries must be received by 12:00 A.M. Eastern Daylight Saving Time, March 31st, 2023.

All entries become the property of the Sponsor and will not be acknowledged or returned. 

6.Awarding Prizes

Between April 1st and on or about April 22nd, 2023, the Sponsor will review all entries and at their sole discretion, decide to make awards to no fewer than nine (9) winners. The Sponsor will attempt to notify the winners by telephone or email on or about April 29, 2023. If potential winners cannot be contacted for five (5) days after the date of the  first attempt to contact them, an alternate winner will be selected from the non-winning entries by the same process as original winners were selected.

7.Winner Notification

The potential winners will be notified by email, phone or mail. Each potential winner will be required to complete and sign a Declaration of Compliance within five (5) days of the date the notice is sent, in order to claim their prize. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, the Sponsor will award the prize to an alternate winner chosen from among remaining eligible entries. Prizes will be fulfilled approximately ten (10) days after notification of winning.

8. Prizes

There will be a minimum of nine (9) five-hundred dollar ($500.00) awards to be used solely for the purchase of Florida Native Plants within three (3) months of receiving the award. Winners are responsible for all labor, mulch, soil amendments, garden tools, irrigation, etc. to create their gardens. Winners agree to provide Audubon with digital photos and updates about their Florida Native Plant garden every three (3) months for two (2) years after winning, and to allow Audubon’s representatives to visit their garden by appointment.  Audubon has the right to use all photos and progress updates on our websites, in social media posts, in newsletters, in press releases, in presentations and in any other media where we promote Florida native plants.

9. General Conditions

In the event that the operation, security or administration of the Contest is impaired in any way or for any reason, including but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor, may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.  The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees): and any other remedies from any person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

10. Release and Limitations of Liability

By participating in the Contest, entrants agree to release and hold harmless the

Sponsor, and each of their respective parents, subsidiaries and affiliates and

other companies associated with the Contest, and each of their respective officers,

directors, employees, shareholders, representatives, and agents (the Released Parties) from

and against any claim or cause of action arising out of participation in the Contest or

receipt or use of the prize (including any travel or activity related thereto), including, but

not limited to:  (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) lost, late, incomplete, garbled, illegible, undelivered, stolen, damaged, delayed, postage-due or misdirected mail, entries, application downloads, (e) any other errors or problems in connection with the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Contest-related materials; or  (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto).  Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorney’s fees.  Released Parties are also not responsible for any incorrect or inaccurate information, whether cause by site users, tampering, hacking, or by any equipment of programming associated with or utilized in the Contest, Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

11. Disputes

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Florida. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Florida, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Florida.

12. Privacy

Information collected from entrants is subject to sponsor’s privacy policy.
